The Provider of this promotion is Kei Trucks Pty Ltd, a company specializing in importing Japanese Kei Trucks. Throughout these Terms and Conditions, the terms “we”, “us”, and “our” refer to Kei Trucks Pty Ltd (ABN 88 670 148 428).

Acceptance of Terms The terms and conditions described herein apply to the Kei Truck Imports Giveaway Promotion facilitated by Kei Trucks Pty Ltd. By participating in this promotion, entrants agree to comply with these Terms and Conditions, which govern the use of our services, privacy practices, and all interactions related to this promotion. These terms are in addition to the Official Rules, which can be found here www.keitruckconnect.com/official-rules, and specifically govern entry and participation in the giveaway.

  1. The prize for the Kei Truck Imports Giveaway Promotion consists of either a 1998 Daihatsu Hijet Kei Truck or a cash prize of $6,500 USD.
  2. Vehicle Prize Description: The Daihatsu Hijet Kei Truck, chassis model S110P, features a manual F5 transmission, 4WD, and air conditioning. The vehicle has an auction grade of 4 and a mileage of approximately 34,362 kilometers. The vehicle is offered in its current condition without warranty except as implied by law. The prize vehicle is “as is” and no additional warranties, express or implied, are provided. The vehicle may have minor wear and tear consistent with its age and mileage, and no claims can be made for defects or deficiencies. The winner is responsible for all registration, insurance, and compliance costs associated with the vehicle once delivered to the designated port.
  3. Cash Prize Description: A cash prize of $6,500 USD will be awarded as an alternative to the vehicle. This prize will be transferred via direct deposit subject to applicable tax deductions and bank fees.
  4. Upon selection of the Daihatsu Hijet truck as the prize, Kei Trucks Pty Ltd will arrange for the prize to be transported to the nearest port accessible to the winner. The prize will be deemed delivered once it arrives at the designated port. From this point onwards, the responsibility for the prize, including but not limited to its collection, registration, compliance, and any associated costs, will be transferred to the winner.
  5. The winner is solely responsible for any and all taxes and fees associated with the receipt and/or use of the prize. This includes, but is not limited to, federal, state, and local taxes. It is the winner’s responsibility to understand and comply with all applicable tax laws and filing requirements.
  6. Kei Trucks Pty Ltd may, at its discretion and where reasonable, offer assistance or guidance to the winner in relation to the collection, importation, and any subsequent steps required to utilize the truck prize. However, this assistance is not obligatory and is provided as a courtesy. The extent and nature of any such assistance will be determined by Kei Trucks Pty Ltd on a case-by-case basis.
  7. The winner acknowledges and agrees that they are solely liable for the prize from the point of delivery at the nearest port. This includes all financial, legal, and logistical responsibilities associated with taking possession of the truck, as well as any costs, fees, taxes, or charges that may arise from its importation, registration, and use in the winner’s locality.
  8. Prizes and all elements of prizes must be taken as is, and when offered or will be forfeited, and if forfeited, we are not liable. All prizes are subject to any additional terms and conditions imposed by the relevant prize supplier. Any failure by you to comply with the conditions imposed by a prize supplier may result in the prize being cancelled or withdrawn without liability of us or our prize suppliers.
  1. You are responsible for any other reasonable costs related to a prize, including but not limited to costs associated with ongoing use of a prize.
  1. Drawing Details: The random draw will take place on 4th of June 2024 at 6:00 AM Australian Eastern Standard Time (AEST). The draw will be conducted using a computerized random number generator at youtogift.com. The number will then be verified by the Raffle Play Woo plugin to determine the winner.
  1. We are not responsible for any dispute between you and any person that you choose or choose not to share a prize with.
  1. Claim Process: Winners must respond to the winning notification email to claim their prize within 28 days of notification. If a response is not received within this timeframe, the winner will forfeit the prize, and an alternate winner may be drawn. Winners will be required to provide proof of identity and other necessary documentation as part of the claim process.
  1. Prize Delivery: Once eligibility and compliance are confirmed, cash prizes will be deposited directly into the winner’s provided bank account within 30 days of prize claim. The vehicle prize will be delivered to the nearest port accessible to the winner within a reasonable timeframe.
  1. Forfeiture: Unclaimed prizes will be held for 28 days after the initial notification. If the prize remains unclaimed after this period, it may be redrawn or disposed of at the discretion of the Promoter.

General

  1. Requirement for Compliance: Participation in the Kei Truck Imports Giveaway Promotion requires strict adherence to the Official Rules and these Terms and Conditions. By entering this sweepstakes, participants affirm their understanding of, and agreement to, abide by all rules and regulations governing this promotion.
  1. Consequences of Non-Compliance: Non-compliance with any of the rules, terms, or conditions of this promotion, at any stage, may result in disqualification, forfeiture of any prizes won, and, where applicable, the obligation to return any prizes already received. Examples of non-compliance include but are not limited to:
    1. Submitting false, inaccurate, or misleading information during the entry or prize claim process.
    2. Engaging in any form of fraud, deceit, or misrepresentation.
    3. Violating the entry limitations (e.g., exceeding the maximum number of allowable entries).
    4. Failing to meet eligibility requirements.
  1. Enforcement: The Promoter reserves the right to conduct investigations into the conduct of any participant and take appropriate actions to enforce these rules. This may involve consulting with and providing information to regulatory bodies or law enforcement authorities.
  1. Rectification Measures: In cases where non-compliance is detected, the Promoter may, at its discretion, provide the participant with an opportunity to remedy the breach within a specified period, depending on the nature of the non-compliance and its impact on the promotion.
  1. Final Decision: All decisions made by the Promoter regarding compliance and potential disqualification are final and binding. Participants agree not to challenge or appeal against these decisions.
  1. Kei Trucks Pty Ltd reserves the right to modify or cancel the promotion if necessary.
  1. Any disputes will be resolved at the discretion of Kei Trucks Pty Ltd.
  1. Entrants’ personal information will be used for the purpose of conducting the promotion and may be used for future marketing purposes by Kei Trucks Pty Ltd.
  1. If you win, you must take part in all publicity, photography and other promotional activity we reasonably require, without any compensation. By participating in the promotion and accepting any prize, you consent to us using your name and/or image in any promotional or advertising activity. However, we will never publish your full address.
  1. We may require you to sign disclaimer and release forms in favour of Kei Trucks Pty Ltd and/or our prize suppliers, which we will provide before taking a prize. If you do not sign, your entry will be deemed invalid and you will lose any right to a prize.
  1. We reserve the right to disqualify any entrant who:
    1. is found to be tampering with or otherwise abusing any aspect of this promotion;
    2. we have reason to believe has breached any of these conditions;
    3. behaves in a disruptive, abusive or threatening manner;
    4. does anything that may diminish the good name and reputation of us or any of our related entities or the companies or agencies associated with this promotion; or
    5. engages in any other unlawful or inappropriate conduct that may jeopardise the fair and proper conduct of this promotion.
  1. In the event the promotion is compromised by non-authorised human intervention, tampering or other causes beyond our reasonable control that corrupt or impair the administration, security, fairness or proper operation of the promotion, we reserve the right to suspend, modify or terminate the promotion, subject to any necessary approval by the relevant gaming authorities.
  1. We are not responsible for entries that are lost, late, incomplete, illegible, damaged, or misdirected, due to any reason whatsoever. All entries become the property of the Promoter and will not be acknowledged or returned.
  1. While the Promoter takes care to ensure all information provided in association with the promotion is accurate, it is not liable for any errors or omissions in the information provided or related materials.
  1. We are not responsible for any problems or technical malfunction of computer systems, servers, software, internet service provider, or e-mail systems, failure of any entry to be received on account of technical problems or incomplete, late, lost, damaged, illegible or misdirected electronic communications, or any combination thereof.
  1. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the ability of us to proceed with the promotion on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, government directive or pandemic, we may in our absolute discretion cancel the promotion and recommence it from the start on the same conditions, subject to any necessary approval by the relevant gaming authorities.
  1. The Promoter is not liable for any damage to prizes caused during shipping or handling, nor for any harm or loss arising from the acceptance or use of the prize. Prizes are provided “as is” with no warranty or guarantee, either express or implied outside of the manufacturer’s limited warranty.
  1. We do not exclude any rights and remedies in respect of goods or services under the Competition and Consumer Act (2010) which cannot be excluded, restricted or modified. However, the remainder of this clause will apply to the fullest extent permitted by law and we, the agencies and companies associated with this promotion are not be liable (including in negligence) for any loss (including but not limited to indirect, special or consequential loss or loss of profits), expense, damage whatsoever which is suffered or for any personal injury, illness or death suffered or sustained in connection with a prize or this promotion, except for any liability which cannot be excluded by law. 
  1. Prizes cannot be transferred, exchanged nor, except where cash is specified, redeemed for cash. Without limiting any other term of these terms and conditions, all prizes (and elements of prizes) must be taken as and when specified, or will be forfeited with no replacement. All prize values are correct as at the date of preparing these terms and conditions and include any applicable taxes. We are not responsible for any change in prize value. You agree that if a prize (or element of a prize) is unavailable for any reason we may provide another item of equal or higher value, subject to any necessary approval by the relevant gaming authorities.
  1. We may, at any time, require you to produce documentation to establish to our satisfaction, the validity of your entries (including documentation establishing your identity, age, place of residence and place of employment). Failure by us to enforce any of our rights at any stage does not waive those rights. 
  1. We are not responsible for any tax implications arising from you winning a prize. You should seek independent financial advice. If for GST purposes this promotion results in any supply being made for non-monetary consideration, you must follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
  1. Without limiting any other clause of these terms and conditions, we and the agencies and companies associated with this promotion are not liable for any loss of, damage to or delay in delivery of prizes, or for any damage that occurs to displayed prizes (if relevant).
  1. This limitation of liability is in compliance with applicable laws and is designed to be as broad and inclusive as permitted by the laws of the jurisdiction of the promotion. If any portion of this section is held to be invalid under the applicable laws, the invalidity of such portion shall not affect the validity of the remaining portions of this limitations section.
  1. This promotion is in no way sponsored, endorsed or administered by, or associated with any social media platform. You provide your information to us and not to any social media platform. By entering, you completely release any social media platform from any and all liability.
  1. By participating in the sweepstakes, participants agree to release, discharge, and hold harmless sponsor, its respective parents, affiliates, subsidiaries, advertising and promotion agencies, and other individuals engaged in the development or execution of this sweepstakes, from any liability, claims, losses, and damages arising out of or relating to their participation in this sweepstakes or the acceptance, use, misuse, or possession of any prize received in this sweepstakes
  1. The failure of Kei Trucks Pty Ltd to enforce any provision of these Terms and Conditions at any time or for any period shall not be construed as a waiver of such provision and shall not affect the right of Kei Trucks Pty Ltd to enforce such provision at any subsequent time. No waiver by Kei Trucks Pty Ltd of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default.
